EEA2 form, section 4

Hi there,

I am myself a German national and my wife who is from Hong Kong is about to send in her EEA2 application. I have problems figuring out who should fill in section 4 of the form (my wife or me). We are both working and therefore either of us could take section 4 to our respective employer in order to have it completed. I have already done the EEA1 application for myself successfully, demonstrating that I am using my treaty rights to stay in the UK.

regarding the EEA2 form section 4. In this case Antonio did actually look at the wrong from for his case, but he also picked up on the ambiguity of line 4.5: Position offered to, or held by, your EEA or Swiss family member (or you).

It really doesnt matter whose employer fills up the section 4 of the EEA2. If your employer fills up the form, then you will be exercising your treaty rights as a worker while if your wife's employer were to fill it, your treaty rights will be on the basis of self-sufficiency.

Just make sure that your wife's employer does not fill in 4.5 of the section with your position or vice versa.
