Hi

I qualified for ILR on the basis of 5 yrs on Tier 1 .My spouse could not apply for ILR as the 2yr period was not completed .

We made 2 postal applications

1) ILR with SET (O) application in November 2012 for main applicant and was granted in ILR in February .

2) FLR(M) application made for spouse in November 2012 at the same time

Since they were 2 different applications that were made .It was mentioned that the Passport and other documents would be sent for the FLR(M) application processing after the SET(O) application processing was completed.

1) When do I have to send the documents for FLR(M)
2) Will UKBA mail me mentioning the documents required now since I have been granted ILR.
3) Do I have to mail,call,send a letter to mention I have recieved ILR and hence my spouse FLR(M) application needs to be processed .

In simple what do I need to do next in terms of submission of my passport and other documents for processing of FLR(M) for my spouse VIsa

Please let me know as I dont know what needs to be done.

You wife can apply as a tier 1 dependent, which is more easier and straightforward.

Once she has completed the 2 years, she could apply for settlement.

Amendment to the law has now been made, which permits this.

We have already applied in November for FLR(M) so there is an application present with Home office pending approval

Why should I pay and apply for another application.

I am looking to send documents as mentioned earlier

Can any one please help

The option is open to your wife to vary her application, and the differences, if any in fees , will be paid or reinbursed.

Here are the documents, she will need to submit to support her application.

If she applies under the PBS dependant system, then no need to pass the English language test, or show maintenance requirement. However there will be restriction on taking post as Doctor or Dentist, unless qualification was obtained in the UK.
