Eu citizen with non eu from UK to travel to Ireland

Post by creweman » Sun Feb 17, 2013 4:53 pm

Sorry to bother you however hope you can help me or answer a question please.

I am British living in the UK with my wife who's from colombia on a spouse visa which runs out on the 5 of march. We are aware that she needs to pass the life in the uk test. And then apply for recency. But if she fails this this would mean her going back home and then having to reapply under the new law. Ie £18,500 etc etc. Which at present is not possible as we ad a business up until December last year but for ed to close due to my wife having a operation. Worried that she might have to go back and me not seeing her for 6 to 12 months I was informed that we could go to another eu country and she could come with me as she's my spouse.
But I am worried as I am. Not working at present, can you please help

I would try and get the UK ILR sorted out if you can.

To answer your question, it would be possible for the spouse of a UK citizen to move with their spouse to another EU country. The EU citizen will be expected to be a worker, self-sufficient person or student after three months have expired.

I have been unemployed for the past 2 months but Xmas not being a good time to look for work, however normally don't have a problem finding work.
Are you saying as long as I am working before the 3 months is up that should be sufficient?
And would I need a visa or permit and if so which ones.
Thank you for your reply
:D

If you move to Ireland (or other non-UK EU country) and work, your wife could remain with you (and also work).

Totally agree with the above comment if you need a plan B. I am a UK citizen but am in Ireland now waiting for my wife's visa. A non-national under EU law has far more rights that the citizen (esp. British citizens in the UK). Check out this leaflet. It simplifies a very complicated issue.
