Given that you are currently living in Germany, after you get married, apply at the Spanish embassy in Germany for an EEA Family Permit. That will confirm that you will have the same EU/EEA rights as your Dutch husband (as he will be). That includes the ability to live and work in Spain.

Are the two of you currently living together? If so, for how long? If it can be shown that you are in a "durable relationship", it might be possible to get the EEA Family Permit without getting married, but do appreciate that this is more problematic.

Have a look at the following link and under general click on visa and take note of the section "RESIDENCE VISA FOR FAMILY REUNIFICATION FOR DEPENDANTS OF EUROPEAN UNION NATIONALS"

Basically, since you are american, and thus a national of a country that has a visa waiver with the EU, you are entitled to apply for your resident permit within Spain, without having to apply for a visa for family reunification before.

Spain has finally implemented Directive 2004/38/EC in "Real Decreto 240/2007, de 16 de febrero". This may make it easier, or at least more clear what your rights are as partner of an EU citizen. See http://eumovement.wordpress.com/info-spain/ for the text of the law.

many thanks for finding this spanish law. we have been waiting for this for a long time. seems to follow very much the structure of the directive (unlike the english implementing regulations).
