unmarried partner stlment visa, breakup, do I have to leave?

Hello

My partner and I are going through difficulties and wonder what my options are.

We are both Australian but he also has a UK passport due to father born here. We settled here in Aug 05 and I have indefinite leave to remain based on our relationship being akin to marriage for more than 5 years.

If all our work fails and we seperate, will I have to leave the country?

I am working and self sufficient and have based my life over here.

Could anyone help?

Yes: you have indefinite leave to remain, and so your right to stay in the UK is not predicated on your being with your partner. As things stand now, after 5 years in the UK - a little way down the track admittedly - you can of course apply to be naturalised as a British citizen, provided you fulfil the other criteria. Doing so would not mean that you would have to give up your Australian citizenship.

Once you have indefinite leave to remain the requirement for the relationship to exist no longer applies and you are no longer dependent on your partner/spouse.
