Please Help...VERY worried

Post by canukgirl2 » Sat Mar 17, 2007 12:53 am

we are in the process of completing our AOS paperwork.

The background.
I entered the us on a TN Visa. We met and got married...but here is the problem.

I have a Canadian Criminal record from 2001. Theft under $1000 (got a fine) and Assisting escape (probabation)

I am worried that my AOS will be denied and I will have to leave.
Can any one help?

Unfortunately theft seems to be considered a "crime of moral turpitude", which would make you inadmissible if it was committed when you were over 18. You can apply for a waiver, but my understanding is that it's only granted either in case of extreme hardship or if the conviction is older than 15 years. See here. I would strongly recommend that you contact an immigration lawyer. You can also try posting in this forum. Some of the people there may be able to give you better advice than I can.
