Marriage Visit Visa AFTER visitor visa, will it be granted?

Post by lostflower » Sat Mar 17, 2007 9:32 pm

Hi everyone. I wanted to find out if i had stayed previously for 5 months in the UK on a visitors visit visa, and if i were to go back to my home country and apply for a Marriage Visit Visa , will they even consider it?

The reason i ask is because I have used up my 5 months in the UK already on a previous visitor Visa, so is it unlikely they will grant a Marriage visit visa for 6 months? Or is it automatically ruled out because a visitor can only be here for 6 months? Or they will consider it ?

I've been in and out of UK several times. never overstayed. and am genuinely wanting to visit the UK to get married as my partner works in the UK (waiting for final divorce papers to be served) before applying and will leave at end of marriage visit to go back home with my work permit partner. Or if he is still working in the UK, go back at end of marriage visa to apply for dependent. (we dont know if his contract will be renewed and have no intention to settle in the uk)

I would deeply appreciate any insight.
I have read through the uk rules and regulations but it doesnt have anything on this.

Please do help out and help me answer. I would appreciate itvery much.

thank you very much for having taken the time to read this.

The category of "Marriage Visit Visa" is comparatively new and I must admit that this board is not exactly crowded with messages about this category of visa. But this how I see it :-

A "Marriage Visit Visa" is merely a type of visitor visa that has the added benefit of enabling the person to get married while visiting the UK. But nevertheless one of the basics of visitor visa still applies. I mean that there needs to be sufficient "reason to return" before the end of the visa period of validity.

So the blunt question is ..... how will you go about proving to the ECO considering the visa application that you will indeed leave the UK before the end of a "Marriage Visit Visa", if indeed it is granted?

John thank you very much for your time to read and answer.

i was stumped at your question. I had assumed if its granted, its only logical to return home to apply for a work permit dependent visa if he was still working in the UK so as not to bend any rules? and if he wasn't working in the uk, then there was no further need to apply for anything.

Would the fact that I and my husband to be are from different countries and having any blemish in the passport would forever seperate us be a good and strong enough reason to always play by the rules? (i mean to me it is but i dont know what others would think)

The 'being from different countries' and him working in the UK is why we would prefer to get married in the UK as he doesnt have 'a lot of time' off work to go to his home country and wait around to file notice etc etc and hang around until we could get married

thank you again for your time.

Well that is the point, whether the ECO would be convinced that you would actually leave the UK and then apply for a visa to return, (and I am not saying that you would do this) or simply stay with your husband as an overstayer.
Would the fact that I and my husband to be are from different countries .....
I can't see how that makes any difference.

Don't get me wrong, I am not saying that an application for a marriage visitor visa will fail, but just setting out the area of concern that the ECO will want to look at.

Thanks John, your insight is highly appreciated. And your setting out the concern was somethng that I had 'assumed' was easily justifiable.

If this route doesnt look so 'good' Can I then ask if I apply for a WP dependant (we marry out of uk), would the amt of time i had spent in UK before have a adverse impact?(example 5 out of 6 mths on visit visa) and constant trips over the past 2 years?

:?:

thank you again. I wish you a good day.
