Someone knows a good lawyer about european law?

Post by etnias » Wed Mar 07, 2007 9:03 pm

Hi,

I am EU citizen and my non EU boyfriend has lost his appeal to the high court for his visa.
I am pregnant and we would like to apply for EU residence card for he, the only problem is that the only way we have to prove that he is my family will be through the birth certificate, and my baby will be due in August.
We are not living together yet and we met each other one year ago.

Whatever advise will be very appreciate

Marriage will clearly make matters a lot easier, and ensure that your boyfriend is within the definition of "family member". As the two of you do not live together the UK does not accept that you are in a "durable relationship" needed for him to get within the definition of "extended family member".

Get married outside the UK, for example in his country. Following such a marriage he would make an application for an EEA Family Permit.

Which country is he from?

Your Problem could be easy, but if wrongly presented, reasonable advise to suit your situation may be difficult.
If i may ask,
*on what basis was the high court appeal.
*Was the visa application made in a diplomatic post/BHC.
*Are you exercising the treaty rights here in the UK.
*Marriage maybe a better option but is not a guarantee as far as the HO is concerned if not durable relationship.
Try and benefits from the pool of ideas on this site before involving a legal representative as a last result.
