Rights to british citizenship for adult children of BOC

I'm looking for clarification regarding the new legislation for the status of adult children born before 1983 to mothers who held British Overseas citizen passports. My brother in law who was born in 1964 in Tanzania wishes to apply for British Citizenship.

His mother has been given nationalisation as she has always had a british overseas citizen passport and her parents were also BOCs in tanzania.

However, I have been advised by a local advise centre that he cannot obtain a British citizenship as the mother did not have a 'right to abode' as the phrase 'subject to immigration control' was on her passport.

Is there anyway he can apply for a british passport either through his mother or grandparents' BOC, or through any changes in legislation recently.

Please advise of any other way can he apply for british citizenship.

Any help would be appreciated

The changes to the 2002 Act only applies if your briother-in-law mother was a British Citizen at the time of his birth.

Since she had a BOC until recently must mean that at the time of your BIL birth his birth was a BOC and a British Citizen. It is very likely that your BIL mother got her entitlement to the BOC via her father under the BNA 1948.

As your BIL was also born after Tanzania received independence he would have probably automatically became a Tanzanian citizen.

I do not believe there are any other ways for him to receive British Nationality.
