I arrived in UK as a visitor on 22nd of November 2004 and left the country on 30th of March 2005. A new student visa was granted on 6th of June 2005 and I arrived on 14th of July 2005.
My wife and a child granted a student dependent and their details are as follow,
Visa granted to my 1st child on 12/12/2005 and he enters to UK on 6th of March. He left the country in November 2007 and enters to UK in October 2008. He was 3 at the time of 1st arrival and now he is 10 years old.
My 2nd Child born in UK during March 2007 but travelled to home country in November 2007 and enters to UK in October 2008 on a new entry clearance which was granted on 24/09/2008, he is now 6 year old.
Since my student visa expires in August 2009 I switch into Tier 2 ICT and working with my employer since. During this time I was undertaking many overseas assignments for my UK employer and had absences from UK. I would appreciate if experienced fellows suggest the best way forward. Can I apply ILR for my children now or what will be best time? I am afraid due to some personal circumstances I am not in position to wait until I complete 5 years on Tier 2.
