I was wondering whether someone could clarify the situation re: spouses of people holding ILR. My sister has been in this country since 2002, married to her husband who has been on all sorts of visas (permit free training, HSMP etc). He is now eligible for ILR but seems to think that my sister would have to fulfill the 10 year rule in order to qualify for ILR. My understanding is that she would qualify for ILR straight away as she has been married to him for over 4 years ( marriage registered in India though) & initially came to this country on a dependent spouse visa.

I have tried searching the IND website for more info regarding this but with little success. Any suggestions would be greatly appreciated.

If she is a dependent of a work permit holder or HSMP holder, then he would include her in his application for ILR. Dependents, including children, get the same status as the primary if they apply together.
