Eligible for Naturalisation but Income Tax query

Post by mkn » Thu Jul 25, 2013 6:14 pm

Hi Gurus,

I would really appreciate if someone could advise as I am really confused on the Income Tax (to meet the Good Character Requirements)

Background:
I was an employed till Aug 2012; in Aug 2012 I decided to go contracting, so start a limited company but unfortunately things didn't work out and I was out of work till Apr 2013,but in March I did a small contract work for a day.

I have become eligible for BC on July 06 2013 but not sure whether to apply for naturalisation without doing the tax returns for 2012-2013(as my individual tax return date is towards the end of the year and company tax return date is next year) and what implication can it have on my application.

My question are

- Do I have tick both the "An employee" and "A Director" in Section 3 in AN1 form or just the employee (as I am currently working as employee since Apr2013)?

- If I tick both then do I have to do individual tax return and Company tax return before applying for naturalisation if not will it effect the decision ?

- If I tick both and DO NOT do the tax return what explanation do I have to give for not filing my tax returns, can I just mention that I still have time till this year end to file tax returns?

Thanks in advance.

Your questions relate to taxation and not immigration.

-Just tick employee and may be you can tick director . (at the moment you are only employee and pay PAYE)

-If you can, then file your personal tax return. (Limited companies have their own tax reference number do not get confused and do not worry about company return at the moment). as you said you only worked for a day as self employed you can get legit tax refund on your previous employment to august 2012.

- Check your online HMRC account to see any outstanding liability from previous years.

speak to your accountant.

in my opinion you are OK even if you do not file your return. its due by January 2014.
Good Luck

p.s. I am accountant
