ILR Grace Period?

ILR Grace Period?

Hi All,

I am on Tier 2 ICT from April 22, 2010.
Can anybody let me know if UKBA has any grace period that they consider for ILR applications? like 15 days-1 month?

As per knowledge any Tier 2 before 6th April 2010 are eligible for ILR, however I have missed this date by 3 weeks approx.

Will I be eligible for ILR in this case? Do we have any work arounds to be eligible? any pointers?

Note: I have been to UK in 2006 and 2007 for 3-4 months assignments on WP.

Your previous work history is irrelevant, as your clock would have reset after a prolonged absence.

You will be ineligible for ILR unless you switch employers. You are eligible to switch employers in-country to Tier 2 general. Your clock would be reset to when you change into T2G. You would then need to meet the ILR requirements for T2G.

Did you apply for your first T2 ICT visa after 5 April 2010?
Was your first T2 ICT leave as "Established Staff"?

Yes Manci...I paid my visa fee in the vfs office on april 22 (I guess UKBA considers that as your date of application), this was the first time i got tier 2 ict as established staff, earlier in 2006 and 2007 it was normal WP.

I also had tier 1 partner visa in between Dec 2009(I travelled just for 1 week on this visa) to April 2010, however it was overridden by tier2 ict.

Will this information help to find some work arounds for ILR? :roll:

Solicitors do not have a magic wand that will let the law be ignored.
For your other query, post in the relevant forum.

That said, what do you mean when you say "I am on Tier 2 ICT since 22-Apr-10"? Did you apply for it on 22-Apr-10 or is that the (valid from) date on the vignette?

I applied and paid my fees in vfs office on the date.
