Visas for children/stepchildren

Post by kelzm » Sun May 20, 2007 8:13 pm

I have a US citizen fiancee, we are planning to marry this year and then submit the I-130 forms so that I can join him in the USA.

He currently lives in the US and I live in New Zealand, I will remain in New Zealand till a PR is granted so that I can continue to work, the ultimate aim would be to be granted the visa and apply for jobs prior to joining him so that there is little downtime between jobs.

The reason for this is that I have a 13 year old son of my own. He currently attends a very good school here in NZ and I have decided that for the first 3 - 6 months I will definitely leave him in NZ with his grandparents. After that time I will give him the choice of coming to live with me and attending school in the USA, or of staying in NZ and joining me for school holidays.

My questions are:

What process should I follow regarding getting a visa for him? If we file an I-130 for him when mine is filed, does this mean he has to immigrate within 6 months of it being issued?

If I don't file and he decides he wishes to join me a few months later will I then have to file for him and wait for processing before he can?

Is there anyway that he can come over and be a student without the residency visa, and if so, would this be faster than applying for a residency visa?

Any answers would be appreciated. :)

I'm not an expert on US immigration, but I'm not sure how it would be possible for you to bring your child quickly to the US, unless he has been adopted by your husband-to-be. A permanent resident can, in principle, petition for an unmarried child under 21, but these petitions take ages to be approved (current waiting time is about 5 years, see here). On the other hand when you become a US citizen you can petition for him as unmarried child of a US citizen, which will be approved much more quickly.

You may want to post in either of these groups, where you can probably find more people who can give you advice:

Thanks Marco,

I'll post on one of those other boards too.

So many things to consider with this move!
