UK Spousal Visa Question

Post by QM » Mon May 21, 2007 8:07 pm

Hi

Not sure this is the correct place for this post, but here goes.

Im a South African married to my German wife in the UK. Although she has never lived in Germany, i have now been granted a spousal visa.

My question relates to how long i can stay out of the UK for, before my spousal visa becomes non in void, and what can i do if anything to extend it since i need to be in SA for upto 5months at a time.

Any advise will be appreciated.

Quinn

Hi Quinn,
Generally your spouse visa will have a limit on it, ie 3 years or 5 years.

If your wife was British and you live continously in the UK with her after 3 years you could apply for naturlisation, however you not allowed to be out of the UK for more than 90 days per year to qualfy.

In short the answer to your question is the limit stamped on the spouse visa is exactly what it says and does not become non in void, because you are out of the country for any lenght of time.

Hope this helps
