EEA2 - COA without right to work - unmarried partners - HELP

Post by Gabie88 » Fri Aug 30, 2013 10:15 pm

Hi everyone,

I am Canadian and my fiancé is Swedish. We've been living together in London for 3 years while i was completing my BA. We applied for the EEA2 permit and I've been giving the Certificate of application WITHOUT the right to work.

My student visa (with right to work) will expired in a month, and I'd like to keep my job.

Could it help if we get married?

Could they change my work status right away?

Any help or advice would be appreciated!

Many thanks.

The UK takes the position that other family members category have to have their case assessed first before being accepted as benefiting from the regulations. Whereas family members rights are automatic.

Other family member - eg unmarried partner.
Family member - spouse.

I understand completely the difference between the status of Spouse and Unmarried partner.

But my question is :
Now that my application is being process, would getting married right now change anything?
Would it look suspicious?
Would it give me the right to work while waiting for the decision?
Can I amend by status of Common law partner to Spouse during the process?

But my question is :
Now that my application is being process, would getting married right now change anything? Yes, you would be a direct family member.
Would it look suspicious? Perhaps to some, but you're already in a long term relationship.
Would it give me the right to work while waiting for the decision? Yes.
Can I amend by status of Common law partner to Spouse during the process? It would be a fact if you were married.
See above for answers.
