Spouse Visa and Separation

I am aware on separating the dependant is given 28 days to leave the UK, however I don't know if this applies if:

1) The Couple is legally married and is yet to go through a divorce
2) They are children (2) from the relationship. Surely one can't be denied access to one's kids, or is it possible?
3) The dependant is gainfully employed.

Can anyone she light on this please.
