Hi All,

I would appreciate you comment and advice on my troubles with EEA3 rejected application. My EEA3 was rejected stating lack of CSI while I had CSI.

Quick facts about my situation are following:

I am a citizen of Czech Republic living in UK for 7 years. In the past 5 years I have been mostly student (MSc and PhD).

Regarding CSI: I have lost my Czech EHIC long time ago. Since February 2013 I have stopped paying insurance in Czech and since then pay for private CSI in UK.

I have applied for EEA3 in February and was rejected for lack of EHIC/CSI. Since the EHIC card cannot be issued for past periods I have received from my former Czech insurance company form E104 which states that I was insured since 2004 till February 2013 (since when I have the private UK CSI).

My second EEA3 application (which included the E104) was rejected due to lack of CSI again. The relevant part of the letter is citing the following reason:

In your statement you have referred to the form E104 issued in the Czech Republic and you state that you are advised this equates to the S1 form issued in the United Kingdom. This is not the case, in fact from 1st May 2010 the S1 form replaced the E109 and E121 forms. The S1 form is a certificate of entitlement for health care in another EEA country for a limited duration and may only be used in limited circumstances of which Student status is not one. Also, the E104 document you have submitted is not translated and is therefore not considered valid evidence. There is no discernable signature on this document and although there is a reference at section 6.1 to the date 01 May 2004 this cannot be corroborated by this department.


My questions are following:

How to provide evidence of past CSI from other EEA country if one paid for it but have lost EHIC card? (replacement EHIC for past periods will not be issued)

The Czech insurance company assured me that the E104 is the right form to provide such an evidence and that anyone in EEA will understand it (translation should not needed) and will accept it. I can imagine to let translate the document, however, I cant do anything about the signature, which, in fact is just a normal stamp and signature. What to do about this?

Can you advice on how (and if) should I appeal?

Your help will be greatly appreciated.

Bank statement highlighting its payment could be a proof. If no replacement EHIC is possible then at least a letter confirming its issuance to you must be possible from relevant authorities.

I would write back to the caseworker who refused the application and ask for reconsideration explaining why you believe they were wrong in rejecting the evidence.

This link seems to indicate that E104 is the correct form to prove your cover - E104. You may wish to add a translation to the document with the reconsideration request.

You may also wish to pay the fee for an appeal (you have 10 days) in case they refuse to reconsider the application.

I am intrigued by your suggestion about writing back to the case worker. However, here are few more questions:
1) Would you send the whole package (all the documents) again to the EEA applications address with name of the case worker in the address or just write to whom it is sent in cover letter?
2) I was looking for English version of the E104, however, it seems not to be available online. Thus, I will have to let translate the document and this will take some time. Therefore, if I will write to the case worker I don’t think that I will have response back on time to appeal (if the response will be negative). Would you say that there might be better chance to succeed by writing to the case worker or by appealing? (I am aware of the additional appeal fee, which, of course I do not want to pay)

1) I will not send all the application again. They have it all on file. I will just send a reconsideration request (make sure to provide your details/case ID so they can link it to your application), the relevant documents (CZ E104) and the additional information (translated document).

2) I believe the reconsideration will be granted. I can't say which route has better chances but reconsideration is quicker (and free). If you don't want to spend money on an appeal, then you can always spend it on a new application if the reconsideration is refused.

See similar case - No EHIC, just a letter.
