Hello.
I married my spouse from the indian subcontinent and she obtained her visa in feb 05 for 2 years. Being new to the UK, she didn't take to well to the change in conditions / lifestyle and generally felt homesick etc.
Not bearing to see her unhappy, i asked if she wanted to go back to see her family etc and she agreed, leaving in oct 05 with intention of returning in due course ( 2 or 3 months ).
Unfortunately, her mother fell ill with heart trouble meaning she had to care for her which also took her over the expiry date of her visa feb 07.
Her mother has since been operated on and has somewhat recovered enough for her not to be bound to anyone else. Having kept in constant touch with her I know she is now more mature and will be able to cope living in the UK.
The problem is do i need to re-apply for a visa as though it's the first time and what questions if any will the authorities ask as to why she didn't return within the alloted timeframe.
My situation has not changed since i applied for her initial visa e.g. employed, homeowner.
Kind regards,
Lahorie

Yes, a further 2-year spouse visa will need to be applied for.
As regards the now considerable time the two of you appear to have lived apart, evidence should be provided to show that the two of you do now intend to live together. Evidence of contact should be provided as regards the time spent apart.

Hello Board
A follow-up to the reply received earlier.
Does anyone know how many wage slips i need to provide for the application. When I initially applied it was 3 months with bank statements etc. Have the rules changed?
Secondly, I was off long term sick and have recently returned to work. As you may be aware, long term sick pay is not a great amount ( about £400 a month is my case). I am now back on full pay, can I use these £400 wage slips as proof of income or is it advisable to just use the full pay wage slips?
I am asking as i want to apply ASAP for my spouse's visa.
Kind Regards,
Lahorie
