Post by Anil » Fri Jun 08, 2007 7:23 pm

Hello
I am from Nepal and I am leaving for Uk this week after getting an ILE visa.I would like to know if a person with ILE visa can apply for a US student visa from Uk.what are the procedures for it.Am I eligible for doing so?If yes, what kind of documents do I need to show and where should I approach for applying for a US student visa?

I was simply asking, Anil two-posts, whoever you are, why go to the trouble of getting ILE for UK and then go off to USA?

If I'm a dumbo then ur a Visa pimp, pal.

Tee hee!
Wanderer is right in asking why (it is expensive to study over there, you know!), but it should be more in relation to how long you intend to be out of the UK? I think the ILE visas, whilst not having a time limit, is the same as ILR in that you shouldn't be out of the UK for more than 2 years, or else you risk losing your ILE status. Can someone else confirm this? So if you are doing a PhD, and haven't even been in the UK for that long but already spend 3-4 years in the US, you might be putting yourself at risk.

At the end of the day, whilst not being a US immigration expert, I do think they will assume that although you have ILE in the UK, you are still a Nepali citizen so must be treated as such? Go to the US embassy website to read the documents there, and maybe check which schools/colleges/universities you are applying for. Have you already decided on which schools? I guess if you want a professional to do it, maybe use Work Permit? (well, I'm not endorsing them, but they do host this site!) I think, like the UK, you need to apply for a course first, then get a letter of support from your school indicating you've paid your fees/have a scholarship and have been accepted to study there. Then you do the whole visa thing.

To be honest, colleges/universities are very good at providing information re visas, they are very detailed, so I'd suggest looking through their international student services pages first.

Once he lands in the UK and is admitted for settlement, he risks losing ILR as soon as he moves out of the UK even before 2 years is up.

Well, there you have it, anil! So I suggest mulling things over before applying to the US.

As long as you have the right to live in the UK, you would normally be eligible to apply for a visa at the US Embassy. However, they might question you as to why you did not apply from your country of origin, paricularly if on application, your duration of stay after entry to the UK is very short. This is mindful of the fact that you are eligible to live in the UK. However, I am not quite sure this may apply to students visa. So, others who have more detaiils can contribute to your post.
