VWP: Arrest and conviction but no record?

Post by New Yorker Wannabe » Thu Jun 07, 2007 6:04 pm

Hi All.

I was arrested and convicted of a driving offence in the UK around 15 years ago. I plan to go to NY in August for a holiday with my wife.

I am fully aware of the visa waiver programme restrictions and as described on the (UK) US Embassy site I applied for a police national computer (PNC) record check. This is required to be taken to an interview at the US Embassy in the UK when applying for a visa. However, the information I received from the National Identification Service states under the catagory of 'prosecution and conviction' that there is no information held about me in the the police national computer.

Has any one else come across this?

What is the likley hood of US immigration having better information than what I and the PNC has?

Thanks.

What type of conviction did you receive? Did you spend time in jail or was this a fine?

None! They would have to source the information from the PNC themselves by request and that is exactly what they would get.
Praise The Lord!!!!

Just what I thought.

No jail time by the way. Just points on the license and a fine.

Offences like this must be deleted after so many years. So much for the rehabilitation of offenders act not applying to US Visa Law. Hard to explain to the US Embassy that I have a prior arrest and conviction if I cannot prove it!

Thanks
