STUDENT IN NEED OF PROFESSIONAL ADVICE

Post by magata » Tue Jun 12, 2007 3:43 pm

Hi all,

A friend of mine came to the UK in March 2003 as a student, his current sudent visa expires next year February 2008. However, he is curious if there are more alternatives available to enable him to stay in the UK following a diiferent route. Therefore, would you please respond to the following questions:

Please correct me if I am wrong but as far as I understand he will only be able to apply for ILR until he has completed 10 years living here legally in this line of status. However, in the meantime, Is it possible for him to switch his visa? and if so which alternatives are there avalable?.

Can he apply from here or Does he need to return to his home country and apply from there?

Your assistance is gratefully appreciated

Please check current regulation, I understand people finishing UK higher education are able to work for a year after graduation (asking HO permission and WP)

What course is he on? Is it a certified Bachelor's or higher?

Yes, it is 10 years as a student.
If he isn't qualified in any specific qualification, and so if he cannot get an employer to sponsor him for a WP, then he's likely to have zero chance of switching into a work-based visa category. He should stick to his student visa, and, if on a degree course or higher, after he graduates, apply for a one year working extension. After that, well, he need to look at the visa types. Try the working in the uk website, it's quite useful.
