Student VISA rejected

Post by jamalkhan » Tue Jun 12, 2007 7:28 pm

Hi,
A friend of mine just had his visa refused for student. He got the place in one of the worlds famous university on merit but the EC was no convienced that he or his family will be able to support him financially.

My questions is that
He has a five year multiple entry visa which has almost four years left. Can he use that visa to Persue his studies? The course is only for 1 Year and he has no intentions of working

Is there a specific law or clause in the immigration rules which prohibits him to study under Visit VISA. He will be coming back home and going back to after 6 months to keep his status valid.

Thanks

Jamal

Sorry but it's impossible, the visit visa is for visits only, doesn't mean six months at a time and certainly not more than six months in any one year.

If ur friend attempts to enter immediately after leaving he will be refused. And if the immigration officer suspects he's been living here on a VV he'll be in more bother.

Your friend needs the correct visa for the correct purpose.

The rules on Student Visas are being tightened as from 01.09.07. Have a read of the new INF5 guidance.

In view of that, I don't think it is possible to do what he might have planned to do.

Umm, But the INF 5 flow chart states that the student "Student rules changes from 1 September 2007 "

What if he is enrolled in August 2007 ??

Still can't do it! Read my post! It is allowed to study on VV but no longer than six months.
