Applying for Citizenship at age of 18

Hi,

I am dependent of HSMP holder. My son was born here and i know that we can not apply for ILR or citizenship for him as we both are on temprary visa.

Recently a friend of mine told me that even though my son can not apply for citizenship now but he will be able to claim the british citizenship at the age of 18 under Geneva Convention.

Does any one has any idea or know something about this scenario.

Absolute nonsense in every respect. Your son will be eligible for ILR if and when you obtain ILR.

Once you have ILR, then your son can immediately be registered as a British citizen under section 1(3) of the British Nationality Act.

Alternatively, if your son lived in the UK from birth until age 10, he could be registered as a British citizen under section 1(4) of the Act irrespective of immigration status. This is nothing to do with the "Geneva Convention".

How old is your son now?

Thanks for the response. I didnt know he will be eligible if he lives here until the gae of 10. He is 3 at the moment.

The Geneva convention relates to refugees, so doesn't apply to your son.

He will be eligible before that if you get your ILR (isn't that the plan?)
