Advise for friend...regarding marrying illegal boyfriend

Advise for friend...regarding marrying illegal boyfriend

It would be appreciated if you could provide me with the appropriate advice so I can pass it on to my friend.

So my friend is a UK citizen (from birth) and she wants to marry her illegal boyfriend in the UK or Albania.

About her: she is in her mid 30's and has two teenagers from her previous relationship, works part time and is topping up her income with public funds. She has worked on & off and paid council tax, bills etc but claims tax credits as a single parent.

About him: he came from Albania to the UK illegally 18 months ago and has been working since. He is in his mid 20's and lives with my friend (his girlfriend). They have been together 1 year and are madly in love.

I have briefly explained the current scenario. Both of them wish to get married in the summer 2014 either here in uk or in Albania. I know that they do not need a certificate of approval but what is the best way to come around this situation?

- What documents do they need to provide to the register office?
- Will they give him/them permission to get married in the UK legally?
- What are the chances of him getting caught or being reported by the register office to the UKBA?
- If they do get married in the UK legally, will he have to apply for a spouse visa from the UK or will it be simpler to go back to Albania and marry then apply from there?
- My friend is living on partaily public funds, will this be an issue?
- My friend already has two dependants, will this be an issue?
- Will my friend be able to live with him legally in the UK after they get married and how long will it take for him to get a British Passport?

I have outlined some questions that might arise. Can you please give the best and correct advice on this situation. What is the best route for them and what are the possible problems that could arise.

An illegal immigrant has right to marry here but it's not so easy, as soon as they apply for a marriage licence the home office is told, also at the registry office you will have to show proof of who they are and that they are here legally

I think Home office is trying to increasing the waiting time after notice to marry someone in the registry now from 15 days to 28 days in England and Wales and allowing this to be increased to 70 days in some circumstances

I don't think it will be that easy specially he is illegal for such a long time.
