EEA1/2 leaving job and interview

Post by JUSTINYK » Wed Nov 20, 2013 9:07 pm

Hello everyone ,
can someone help us and share experience with us ?
I got my eea fp in october from tunisia ,
we had separeted phone interview me and my eea national wife,
we send her job contract and payslips and job confirmation..

so , now we preparing to apply for EEA1/2 ,
do you think that keeping her current job, can make our application easier and cleaner , cause they already checked everything .
what is better ? to keep the job ? or is the same ?
because we think that i feel she will keep it , gonna be faster :)
(we know that with law is the same , but u know , is always better to make it cleaner) .

an other thing , do you think that we can have a second marriage interview for eea2 application ??
and how we can pay the 110gbp (application fee for 2 person)

Help us pleaseeeeeeee ,
we waiting and we so appreciating.
kind regards.

i assume you already in the UK ?

Well if she working in the UK then you can submit the application now
She don't need to send EEA1 but no harm in sending if you want to spend extra £55

Application form:

http://www.ukba.homeoffice.gov.uk/sitec ... /eea21.pdf
http://www.ukba.homeoffice.gov.uk/sitec ... /eea11.pdf
http://www.ukba.homeoffice.gov.uk/eucit ... /applying/

No one can tell you if they will ask you to come for an interview / or may be home visit

it depend on the caseworker.
UK Student Visa : 04/2004 - 09/2009

we are confiused about "EVIDENCE OF RELATIONSHIP / GENUINE MARIAGE"
we was already dealing with EEA FP , and we got interview and we was dealing with all ,
so i was wondering if i need to send again , (photos, skpe conversation, air company ticket, ..) OR they have it alreadyy ,
AND the fact that i got my EEA FP is confirming that our mariage is genuine , no ??

can i found here , in the forum , a checklist of a successful eea2 application ??

thank you so much askmeplz82 for replying and helping ,

i didnt found any opinion about this answer :

- if i had already EEA FP , and phone interview both of us , and my wife (eea national polish) keeps always the same job , that can't be already A CLEAR CONFIRMATION about our relation and that she exercing her treaty rights in UK ??

You still need to submit a marriage certificate to show you are still a family member at the time of the application. No need for the extra evidence you provided previously.
You still need to show the EEA national is exercising treaty rights at the time of the application even if you have proved that previously.

To be honest, I don't think they actually have access to the documents. They would probably have access to your file with details about the application. In any case, I would not worry. Provide current evidence and you will be fine. It's very unlikely they will suspect your marriage at this stage.

Oh thank you Jambo for your answer ,
to be honest what you said is true, but no one knows !!!
and today , after listening to PM speech about limiting the immigration , i am a lil bit prudent about my application ,
Is not going good between UK and EU,

so, for that reason i am trying to do my best with my application , and finnally its depands on UKBA .

@JAMBO :

Please can you help again with this and i am sorry to ask many question :

this is our situation and this what we will do :

1) we will apply for EEA1 and 2

2) currently, my wife is working and she have all right in uk (i got eea FP one month ago)

3) we will apply using work contract and pay slips for her CURRENT job .

4) My wife WANT and NEED to change her work .

So ,

I) what if she will change her job WHILE they are dealing with the application ??

II) what if they will call her employer and he will say that she stopped work ??

III) they can refuse our application because they don't have new job detail and for them will be that she don't EXERCISING HER RIGHTS IN UK ?

IV) should we wait till that she will get new job and avoid this COMPLICATED case ???

V) Should we write a cover letter and write her plans to change job and MAYBE that will be done while they dealing with the application ????

VI) Should we call UKBA and ask before applying or what we can do ??

VII) we worried about my residence card because as we can see every day is a change in the EU immigration law in UK !!!! as the case of government benefits rules for EEA last week !?

i asked few times here about that and no solution or no answer

PLEASE ADVICE US , WE NEED YOUR HELP , THIS SO IMPORTANT FOR OUR FUTURE AND WE CONFUSED AND TO BE HONEST WE LOST .

How likely is it that she will change jobs in the next month or two? If very likely, might be worth waiting with your application. Otherwise, I would just submit her current job and it she changes her job, send updated documents to the HO with her evidence from her new employment.

I would not worry about the talks on the news. It will not affect you now (and I don't think it will happen anyway).

Thank you the answer dear Jambo,

We don't know how much time will takes her to change the job but is between 1 and 3 months .

we have all papers and we can send applications end of next week .

but we don't want to do a BIG mistake and get our self in troubles with UKBA .

So better to wait 1 or 2 months and have peace mind CONCERNING THIS (because they can hassle about ant thing as i can read !! ).
Or send ASAP the application and send by post again new employment details ??

to be honest Jambo , is a nightmare for us , my wife struggling with job and we WANT and NEED RC , and we don't want to make life complicated and deal with such a similar stuff ,
so i want to find out about the best and the most guaranteed solution for us :/

There is no gurantee in life (apart from death).

If you really need the RC, apply now and update by post when she changes her job.
