UK Spouse Visa

Post by MrKay » Fri Nov 22, 2013 4:22 pm

Hello everyone and thanks in advance for your time. I really need some advice. Okay. I am a British citizen and my wife (non-EU citizen) has been in the UK since November 2011 on a spouse visa which will be expiring soon so she will apply for either the ILR or an FLR (M).My wifes passport states no recourse to public funds. My main question is whilst she is here on a spouse visa can I still apply for benefits such as child benefit, child tax credits and working tax credits. If I am eligible to these benefits can you please provide any links to a verified goverment document that states this as I want to make sure I have some sort of document that shows I am allowed access to these benefits. Also if she gets an FLR (M) will I be able to claim any benefits? Thank you for reading and any help will be massively appreciated. (Please provide links to verified documents where possible)

You can claim child benefit in your name and tax credits in joint names. See the Guidance (click) at page 17 and child benefit (click).

Why are you considering applying for FLR(M) instead of ILR?
