Tier 2 General Application - Help will be very appreciated

Post by ABasu » Fri Nov 22, 2013 6:36 am

Hi,

I have had a few questions about my visa and this looks like a great place to ask!

The situation-
1. I first went to the UK on a Work Permit in Sep 2009 and was there till Sep 2011.
2. I came back to India and stayed here from Sep 2011 to Dec 2011
3. Dec 2011 till Aug 2013, I was in the UK again on Tier 2 ICT LTS and my wife and child were on dependent visas.
4. We are back in India now since my project had ended and my visa is valid till 19 Dec 2013.
5. My wife has got a permanent job offer (CoS and all) from the UK. We are in the process of applying for Tier 2 General for her as the primary applicant and my daughter and I as dependants.

My questions are as follows -
1. Documents needed for the T2 General applications - We are submitting the passports, previous BRPs, her offer letter, copy of CoS, marriage cert and daughter's birth cert with the application forms. Is there anything else that I we to submit as well? Any letter from the employers? Our (primary and dependants) maintenance is already certified on the CoS. Would be great if someone could confirm the document list.
2. Considering that I have already lived in the UK for 2 years on the new ICT visa, what is the maximum that I can stay now as a Tier 2 dependant?
3. As I understand, since my own last ICT visa was issues in Dec 2011, I am not eligible for ILR even if I complete 5 years of residence as the Tier 2 General dependant now. Is this correct or am I still eligible?
4. If I am not eligible as per point 3 above, can I stay on Tier 2 General Dependant visa now for the next 5 years for the ILR eligibility? Or will I need to come back in 4 years since my total Tier 2 stay would be 6 years then.

Would be awesome if someone could reply to these queries!

2. Considering that I have already lived in the UK for 2 years on the new ICT visa, what is the maximum that I can stay now as a Tier 2 dependant? no time limit, you can stay as long as the main applicant (your wife) does

3. As I understand, since my own last ICT visa was issues in Dec 2011, I am not eligible for ILR even if I complete 5 years of residence as the Tier 2 General dependant now. Is this correct or am I still eligible? It is correct, you are not eligible. It is unfortunate that your job finished because if it had not you would be eligible for ILR in 2014.

4. If I am not eligible as per point 3 above, can I stay on Tier 2 General Dependant visa now for the next 5 years for the ILR eligibility? Or will I need to come back in 4 years since my total Tier 2 stay would be 6 years then. See the answer to Q2 above. You will not become eligible for ILR after 5 years as a T2 dependant

So let me understand this.
If I go now as a Tier 2 Dependant, I can stay for the next 5 years and apply for ILR in 2018?
