Well my girls visa application was refused in August and we got word a few days ago that permmision to appeal was refused a couple of weeks back, hmm poxy solictitor didnt even bother to tell her.
Damned solicitor has been rubbish all the way through £7k wasted, I have doubts they are even genuine solicitors but her money is paid and you hope they are. But despite asking several times they havn't even sent her a copy of visa refusal letter, and no copy of appeal refusal either makes me wonder if they even submitted visa application.
So shes now here as an illegal and had a letter from Capita that she must leave the country.
Plans kick in that we need to get ready to bug out and start exile in the Emerald isle.
It's a bummer when you are sixty and not in the best of health, but hey I love my girl and will go to hell and back to stay with her.

Enough of my hard luck, the intention of this post is to express my respect to certain posters, Vinny, Obie, Jambo and especially Brigid, they alway seem to be here with pearls of wisdom. Just to let you know its appreciated.

What exactly is the reason for refusal? are you exercising treaty rights? if so it is absolutely nothing to be worried about, you can always re-apply.

Reason for refusal was it was late being submitted according to what solicitor says, partner submitted in time but to solicitor but apparently UKBA recieved it late so she was here as an overstayer.
If she resubmits shes still as an overstayer and they can refuse so far as we can see.
Solicitor has been a total waste, they are now saying she should submit an EEA2 form, no nothing to do with treaty rights so really false, bad information.
She came in on student visa in 2009 which ran out 2012. Solicitor charged £3000 for visa application in June 2012. Demanded to apply for BRP early August 2013, Visa refusal late August 2013, appeal submitted at cost of £300, told November appeal was not allowed in October, suggested re-submit application and paid another £3000 but I think shes throwing good money away.

What is your nationality and is this person your children or partner?

Sorry to hear about the way your solicitor has acted. There are steps that can be taken against them.

I am happy to assist, but in the absence of the full picture, I am not sure I can give constructive advice.

I am very much English and my partner Pinoy. Obie my friend I dont seek your wisdom, theres plenty of it for me to find on here thanks to you guys.

I'm resigned to the fact that I have to sell up and get out.

I only posted to say thanks.

I know there are steps to take against the so called solicitor but I'm thinking they can just take the money and wait for the customer to be booted out, so what ya gonna do about it sucker.

Something that is a pain in the but is that she has divorce proceedings under way against her Filipino husband, shes been living here seperated for more than 4 years. Divorce is not allowed in the Philippines so if she goes back she faces 7 years jail for adultery. We intend to marry eventually but at the moment she has lost the right of residency which is needed for foriegn nationals to marry in the UK.

Hi 375mag,

Just want to say that i am a filipina my self and your chosen solicitor seems to be a total rip off!! 7k is a lot! My current solicitor who i think is very slow and does not deliver up to my standard asked me of total £750 half of it has been paid for.

He promised me to send my eea4 application in May and in July i found out he didnt send them. So in plan to replace him to a better one.

I think if you know the rules and laws it would be better to file the application your self. And when court is needed then thats when solicitor should be seek out for help. Sometimes theyre are the one that slows your progress!!

Thanks kristine, so true about do it yourself its not rocket science. But shes too trusting and has the opinion that solicitors are going to be honest.

She came in on a student visa, course arranged and paid for in PH. After a year she submitted her work to be told the so called college didn't exist. Paid for another course and again after a year went to hand in and was told the school was not longer doing that course so she had no way to get her NVQ. So 2 years wasted and she couldn't extend her student visa so tried for FLRO.


Had to submit for BRP in August so thought FLRO was ok. Never got the BRP.

Waited over a year to be told in August application refused because solicitor was late submitting it.

Intructed solicitor to appeal

Recieved letter from Capita saying she must leave UK.

Told in October appeal would not be accepted, resubmitted application for FLRO hoping to buy a bit of time while divorce is going through.

Its been a case of rip off Britain all the way.
