Tier 2 ICT switch to Tier-2 dependent

Hi all

I have query for my case. I came to uk in April 2011 on tier-2 ICT (visa issue date 7th April 2011 applied in March 2011). My wife accompanied me on the assignment on dependent visa. She found a job here and working with a local employer.

Her organisation has sponsored her for tier-2 general visa (she had to apply from Home country). She has got visa starting from 1st January 2014 valid for 3 years. She is still in the home country and will arrive back in January when her tier-2 visa validity starts.

I am still on tier-2 ICT in UK with visa valid till end of April 2014. My questions are following

1. Since my wife is still in home country and not in uk, am I allowed to apply for Tier-2 dependent visa before (say in December 2013)?
2. Can I apply visa from within UK or do I have to apply from home country?
3. Can I apply for ILR in 2016 considering I would have completed 5 years in UK.

Please provide your views on my case.

1.
you are not going to be granted leave to remain as your wife's dependant before her T2 visa has been acvtivated, i.e. she has arrived in the UK. Read also: http://www.immigrationboards.com/viewto ... ght=travel
