maternity leave

Post by DNEOLA » Tue Nov 26, 2013 6:11 am

Hi

I am due to apply for my ilr on the 18/12/13. I am currently on maternity leave starting from the 23/08/13.

My question is inspite of being on mat leave I easily qualify the salary requirements. Even if I qualify do I still need to submit documents evidencing maternity leave? I am wondering if I can avoid the additional paperwork as I already qualify?

Please can someone advise if they have been through a similar situation and what did they do

Thanks

You can choose to ignore it (omit this information). Just apply on the basis of your income in the past 12 out of 15 months in the usual way.

I entered the uk on the 31/01/09. The entry clearance was issued on the 14/01/09. When is the earliest I can apply. I am confused about the guidance as I don't want to get a rejcetion

Is it true you have to be in the country on the date you appy?

If you could give me some links to the guidance It would be helpful

Thanks

Check page number 21 on this link.

http://www.ukba.homeoffice.gov.uk/sitec ... iew=Binary

"The period between entry clearance being issued and the applicant entering the UK may be
counted toward the qualifying period, as long as it does not exceed 90 days. This can occur
if the applicant is delayed travelling to the UK. Provided the period of delay does not exceed
90 days, it will not be counted as an absence"

You are good to apply 28 days before 14/01/2014.

Thats great ..while counting 28 days do I need to include the 14/01/14 and the date I attend peo. For e.g I am looking for appointment on 18/12/13 will this be ok?

Also with regards to absence leaves it has always been less than 180 days each year. Do I still need a letter from employer for annual leave. I have always been on tier 1 general visa

Thanks

Hi Dneola

As per calculation 18 Dec 2013 is fine for ILR.

Its better if you take letter from employer, otherwise if your holidays are not too much then self declaration letter will be fine (as we see people in this forum got their ILR approved without any letter from employer Check this http://www.immigrationboards.com/viewtopic.php?t=151632)

Correct me if I am wrong.
