Hi,
I have a query about switching from T2 ICT to T2 Gen in UK and then going onto ILR. Please help me out with the same.
Visa Details:
1) Tier 2 ICT (Established staff) - Valid from Nov-2010 to Dec-2012
a. First travel on this visa to UK was on Jan-2011 which ended in Oct-2011 and I went back to India.
b. Got married and my wife got dependent visa and we both travelled back on Apr-2012
c. Project was ~till late 2013 so company applied for 1 year extension in Oct 2012
2) Tier 2 ICT (Long Term staff) - Valid from Dec-2012 to Dec-2013
a. Continued our stay all along this period since we came in Apr 2012 and did not go back to India except for 2 weeks holiday (Apr 2013)
b. Project got extended for some more time so company applied one more extension.
3) Tier 2 ICT (Long Term staff) - Valid from Dec-2012 to Apr-2014
a. Actually the company should have applied for a 1 year or 2 year extension but looks like internal politics; they don’t want people to have old visas. They just have applied for the duration of my stay here.
Questions:
1) When will I be eligible for ILR? Nov 2015 (coz I got visa in Nov 2010) or Jan 2016 (as I travelled to UK on Jan 2011)?
2) Am I eligible for ILR if I manage to get my current employer to extend my visa until I complete 5 years here?
3) Am I eligible to switch to Tier 2 (General) if I have a different employer ready to give me a job and sponsor my COS?
4) If yes for Question No.2, when I switch will I be able to get my wife over as well or should this be done once I get my visa?
5) Will the 5 years clock get reset if I move from Tier 2 ICT to General? i.e. instead for being eligible for ILR end 2015 or early 2016, will it be 5 years from the time I get into T2 General?
