please need your advice

Hi members
I need your advice and thought please.
Basically I got my ilr through 10 yrs long residence. While my application on process I apply for my wife flr(m). Because she was on tier 1(G) DEPENDANT, and she came to uk as student dependant in 2005 and after that some renewal , PSW ,THEN TIER1(G), I did not fill financial section.(i thought she don’t need itEven I earned 21k a year). But ukba refuse because of financial req. I have the entire document to prove that I earn more and submitted to court. Also after my ilt I applied for my children British passport. Give all the evidence to court
Hearing was on November 7th. After three weeks I received appeal allowed letter from court.
Appeal was allowed under immigration rules and allowed under article 8 family and private life, but they gave 5 days to UKBA to appeal
I thought that’s it. But I received letter again from the court say. NOTICE OF RECEIPT AND SAYS UKBA HAS MADE THE APPLICATION FOR PEMISSIONS TO APPEAL TO THE UPPER TRIBUNAL. And also says ‘’you will be informed of the result in writing’’
My lawyer said no need to do and just wait
Please give me some advice .seniors please share your views

Your solicitor is right - you have to wait and see.

They've asked for permission to appeal - they may, or may not, be granted it.

If they are granted - then they can appeal. If not - they can't.

is it normal that UKBA always appeal to upper tribunal if they lost in first-tier tribunal?

other seniors please share your idea

It is not normal or also not not-normal. It just depends. Whatever they do, there is nothing you can do apart from going with the flow and fight your corner.

You just need to wait.
