Discretionary Leave To Remain Extention

Post by LouisGab » Tue Dec 03, 2013 1:53 pm

Hello all, I'm new to this Forum, my name is Louis.
I applied for DLR in July 2012 before new rules came into play, and was an overstayer. Applied based on private/family life, the mother of my children (2 british) supported my application as my partner and I got my visa in March this year. Its the usual 2 and half years but my family life has now discontinued, will I still be able to extend my DLR when its due in 2015?

URGENT

You are on a 10 year route to settlement, extensions will be for 2.5 years at a time on form FLR(FP). It depends as to your circumstances as to whether or not an extension will be granted.

Thank you. Is the 10 year route applying to rules before the changes on 9th July? I'm now living away from my partner and children, but still use same home address. I am also looking to start a business but not there yet. I am in a different relationship now though I could still look after my children but have not continued the family life for 7 months now. Would mu partner have to also support my DLR extention due to having children with me or can somebody else support this?
Thank you very much for quick response.

It's not the date that you applied, it's the date of tribunal decision, so new rules I'm afraid.

So far as exception 1 (click) applies you should be ok.

I have been trying but the relationship with my ex broke down and understandably it has been difficult because she thinks I wanted only visa but I will try again in near future.

If she denies you contact, take her to court. If there is no domestic violence involved, then the whole thing can be dealt with without a solicitor. Solicitors usually charge a fortune for this type of cases, but you can shop around. Expensive solicitor does not always mean a good solicitor.

Just make sure you do not keep texting her or emailing her if she does not want to communicate with you.

Oh no she has not denied me contact, the woman I'm with right now also has issues with my situation I.e having children, so it's all complicated. I would see the children if both sides were happy but I suppose it shouldn't matter. My ex partner does communicate this with me.
