EU child visa free travel with non EU passport.

I am visa national married to an EU citizen and I hold a residence card. Our 2 year old child has an expired 1 year temporary EU passport. Due to last minute xmas plans we have acquired a non EU passport for him from my country's embassy so we can travel to mainland Europe. We did not have enough time to get him a permanent EU passport.

My question is, can my son travel freely around the Europe with a non EU passport with both parents, marriage certificate, expired EU passport and UK birth certificate.

And will we have any problems returning to the UK?

We will be driving through Dover and Calais.

Should be fine. If you travel early in the morning you might not even see any French immigration. I never met them before 7am....

my question is if we would have issues coming back to the uk. from what i've read we shouldnt have any issues in mainland europe. wouldnt want the ukba to mess us up.

You won't have trouble coming back. If any trouble, I would have thought would come from French immigration not UKBA.

See 11(4).
Once you show the expired EEA passport + birth certificate, it should more than obvious they should allow entry.

Hi all, just an update.

We managed to travel by ferry through Dover and Calais with only an expired EU temporary passport for my son. We were in a rush to catch our early morning ferry and even forgot his non EU passport. At Dover there were no French border guys so no checks.

On our way back at Calais, the UKBA just questioned us for about 5mins about why we had not renewed his passport and I explained why, a quick check with his superior then he let us through. He didn't even ask for any other documents.
