Advise: American Child here in the UK.

Post by Peachoct6 » Wed Dec 11, 2013 1:11 pm

(I am asking on behalf of a friend)
My child is American and here with me in the UK. I came into the UK on a student visa however i did not apply for any visa for my son.

I understand he needs to a Visa to stay with me till i complete my studies which would last more than 90 days. Please I need advice on how to go about the visa application as i have no clue on what to do. I have gone through the UKBA website but cant seem to find anything.

Please help because its urgent.

Many thanks in advance

Student dependent I think.

Though I think care is needed, if extended time was taken to have/care for the baby, could be her visa was curtailed?

i am confused

is the child UK-born, or did he enter the country on a 6-month visitor leave on his US passport?

if the former, you do not need to do anything. UK-born children are technically subject to immigration control, but are not deemed to be here illegally (he would however require a visa to re-enter other than as a visitor)

if the latter, i am not sure you are even allowed dependents under tier 4 nowadays, other than UK-born, unless a postgraduate student

and nothing can be done about it inside the country, have to go back to the states
