Work permit application question

One of my work colleges is currently employed with us as a Student dependant, however he wishes to Change to a work permit and change his wife to a dependant visa.

He has been working in our office for about five months and will add his experience that he has gained here to question 43 of the application form. Having added his experience to this question, it seems quite farcical to now advertise this post. Would it be possible to go straight to question 76 ad state that we are employing him based on his experience and knowledge that he has gained already while working here hence there is no advertising.

Or

Is it still okay to add this practice experience to question 43 and advertise knowing that we will employ him regardless of who applies for the job

I am afraid you will find that the guidelines specifically exclude hiring a specific person or creating a vacancy for a specific person--which is what you are describing, seems to me. I think your colleague will have to play the advertising game (and hopefully their sponsor company will too).
