Absences from the UK - evidence / proof

Post by oalbany » Fri Dec 13, 2013 4:16 pm

Hi,

I am applying in person for ILR through ancestry (5 years in the UK as the grandchild of a British born grandparent). I understand that Section 9 of Set (O) does not apply to me.

Do I need to provide EVIDENCE from my employer of my time away from the UK for short periods of annual leave or conferences overseas?

The absences total much less than 180 days per year (I have averaged 30 days out of the country each year, never consecutively) and were largely holidays or attendance of conferences.

In an attempt to answer my own question and perhaps help others, I don't believe I have to provide this evidence, based on information from this page: http://www.ukba.homeoffice.gov.uk/polic ... les/part5/

I have not violated any part of section 128 (a) in that I have not been outside of the UK for over 180 days at a time (or, in my case, at all). Going off of Section 192, proof of absence is only required if the terms of 128 are not met.

Thanks everyone - good luck with your own applications.
