Tier 2 ICT post APr 2011

Hi

I am working in tier 2 ict sine June 2011 and i have a new sponsor who is willing to sponsor for tier2 gen.

I understand that i cannot apply from within Uk, however i am unclear if i go back and apply from my home country, is that allowed or i have to serve cooling period of 1 year.

Please advice, i have not getting any information on that and ukba policies are not very clear on this.
