UK Naturalization- Please help- advice needed

Post by ITGraduate » Sun Dec 22, 2013 6:37 pm

Hi There,

My wife has ILR ( got 3 days ago)

She has been living in the UK for last 11 years and we been married for 5 years. I'm British.

My query:

1- Can my wife apply for naturalization immediately given I'm British and we been married for 2 years

OR

2- Does she have to wait for 12 months before applying for naturalization

Please advise

Thanks

Jafar

Hi Amber,

Quick query, I called Home office and I was told my wife has to wait 1 yr to apply for naturalization.

Usually they give incorrect information hence I called again and I was told she doesnt have to wait for 1 yr after ILR

WE got married 5 yrs ago and I am british. I never made her my dependent. She got ILR on her own 10 yr legal stay in the UK ( long residence )

IS it true she has to wait 1 yr after ILR to apply for Naturalization

Please advise

Thanks

Asking the question again won't change the answer.
She doesn't need to wait.

Thanks for your response Jambo

Although your response is very helpful and gives comfort, please could you direct me to a place where I can get some information on this.

I would like to attach this page ( as a print out ) with my wife's application. I dont want to lose my application fee. The Home office member told me dont apply now as your fee will not be refundeded

the 2 ladies i spoke to told me my wife has to wait 12 months on ILR before she can apply as she was never my dependent. A gentleman at homeoffice told me she can apply without waiting 12 months

Please help me - I'm confused with mixed responses although I trust yours and other senior members on the forum

Merry Christmas and A Happy New Year

Cheers

From the link Amber referred to:
Immigration time restrictions
You must be free from immigration time restrictions on the day you make your application.
If you compare that to the standard requirements which state
You must be free from immigration time restrictions when you apply for naturalisation. Unless you are married to or the civil partner of a British citizen, you should have been free from immigration time restrictions during the last 12 months of the residential qualifying period.
