Failed HSMP Extension because of insuff documents and TOEFL

Post by lupolupus2 » Mon Jun 25, 2007 7:01 pm

Hi all,

My HSMP extension application failed because

1. The P60 did not match with the salary slips
2. My TOEFL was not accepted as proof of English language requirement, since it is a paper-based test and does not cover spoken English

Otherwise, I achieve the required points.

Thus, if I take an IELTS and submit the correct evidence for the salary, I would meet the criteria.

Could you advice on what should I do? Can I get the caseworker to review my application? This would involve also returning my passport, in order to allow me to take an IELTS.

Alternatively, would it be possible to file a second HSMP extension?

Thank you very much for any information you may be able to give!

lupolupus2,

Was the P60 total less than your claimed earnings? And, if you use the P60 total instead, will you still make 75 points?

Hi LondonBlonde,

Thanks for your response! Indeed, the P60 had less than the claimed earnings, but even applying the P60 earnings I make the required points.

Best,

This is good then. I think you should speak to an immigration solicitor straight away as they will be able to help you successfully appeal.

You could do it yourself, but if you fail this time I think you could be looking for work in your home country. Best to make sure your appeal is well presented with the help of a professional.

WorkPermit.com is a good place to start looking for a solicitor.

Good luck to you,

hi,
I have taken a letter from my college and my university for medium of instruction. As its written in the guidance notes, that should be allright I think.

Hi LondonBlonde,

Thank you for your encouraging reply! Do you think I stand a chance to challenge their decision, even though I do not have the IELTS?

Best wishes,

Wolf
