Help with any loop holes

Post by davew88 » Fri Dec 27, 2013 11:09 pm

Hi,

My Fiance is due to come over here in 3 weeks and it has been a bit rushed. However she wishes to stay for a longer period than the allotted 6 months. Could she leave the country on a short holiday and then return and just use the travel visa. She isn't looking to work just here to spend time together and we didn't want to get other visas involved as we plan to get married in another country and only stay here for a year.

Any help with this would be much appreciated.

You're suggesting she comes on just visitor visas?

Well - the plan of 'exit and come back quick' MIGHT work. It also might result in a rejection and a return to country of origin - and that's the more likely result TBH.

You should also be aware that if her circumstances are such that she cuts ties with her home country and comes over - she might be rejected on FIRST entry due to not being considered a visitor.

Wanting to stay for 6 months will raise eyebrows in the first place ... which might lead to further questions ... which might reveal she's nothing to go back to and a fiancee in this country ... which might result in a turn around at the border.

It's all mights and maybes though as it entirely depends on the ECO on the day. If they ask the right (or wrong depending how you look at it) questions - she might get through with little questioning or she might get turned around.
