ILR_Tier 2_Days Short_5 Year Period

Hi Everyone.

I have got a friend who is under the following situation.
1) Granted worpermit on 15/06/2009 (issue date) through in country application till 15/05/2012.
2) Extented his visa through Tier 2 which expires on 27/04/2014.

He is 49 calendar days short of 5 year period. Is he eligible to apply for ILR in April this year. If not, what can be the best course of action for him. For your information he has not changed his job during this period. I would appreciate if he can get an expert advice.

Apply to extend by post and then vary to SET(O) from 28 days before 5 years completes.
