Once you get your visa, then your dependant should also get their visa if you submit all the necessary documents with their application. I hope you have include being married with a child in your own application?

Yes i have mentioned in my application that I am married and having a child, but I have also mentioned in my application that they will not travel with me because of the uncertainty of embassy behavior. does it effects or matter? as all requirements for dependents will be intact with me. plz comment

You have the right to change your mind and decide to take your family with you to UK. There is no UK law that deny you the right to bring your family with you.

HI

We are in the same situation.

My two brothers applied for Tier 1 Ent from Pak as Ent. team which was refused initially but after 6 months!! AR review process decision has been overturned and now my both brothers got visa in mid May. They still they are in Pakistan and haven't travelled to UK yet after getting visa as they want their dependants to travel with them.

Both of them have dependents - one of them have spouse and one kid. But kid was born after our application and thus he couldn't mention him in my Tier 1 E application as depend.

Similarly other bother did nikkah after application decision and while it was going through AR review process. Now he is getting married (just rukhsati/walima) in July thus he didn't mention his wife in his application.

We read in i think rules/guidance that dependant can only apply if their name was mentioned in the sponsor i.e. Tier 1 Ent visa holders application.

Do you know if there is anyway we can apply now for new baby for one brother and new bride of the other.

I will really appreciate your help.

well obviously you can include new dependents if they did not exist at the time of original application! to suggest otherwise would be kafkaesque....
**Please note, you can no longer contact me by PM because owners of this board accused me of using it to recruit clients, and disabled my ability to read and send PMs.**

Thanks - yes common sense says so but there is this rule 34D which states

34D.Where the main applicant wishes to include applications or claims by any members of his family as his dependants on his own application form, the applications or claims of the dependants must meet the following requirements or they will be invalid and will not be considered:

(i) the application form must expressly permit the applications or claims of dependants to be included, and
(ii) such dependants must be the spouse, civil partner, unmarried or same-sex partner and/or children under the age of 18 of the main applicant.

May be I am not understand this properly!
