residential qualifying period for BC for wife

Post by guri_78 » Sun Jan 05, 2014 12:19 pm

Hi Guys,

I came to UK on HSMP visa on 11th May 2008 and got tier1 extension and then ILR on 7th Feb 2013.

My wife came to UK on 7th Aug 2009 on dependent visa and then got her tier1 dependent extension and ILR on 7th Feb 2013 with me.

Residential qualifying period says

"been resident in the UK for at least five years (this is known as the residential qualifying period); and"
"been present in the UK five years before the date of your application; and"
"For example, if we receive your application on 25 March 2010, you must show that you were in the UK on 26 March 2005.
"

Now, I am eligible for BC but I think my wife is not eligible because she came on 7th Aug 2009, so around 4 and half years. Will she need to wait for another 6 months?

If I apply mine now and then apply her after 7th Aug 2014, will be treated as a wife of BC in case I got the BC before 7th Aug.

Please suggest what is the best way to apply. Should I also wait till 7th Aug.

Cheers

I got the following ans...thanks

If one applicant meets the 5 years residence requirement but the spouse doesn’t, then once the applicant is granted BC (after the citizenship ceremony), the spouse becomes a spouse of BC and can apply for naturalisation under the 3 years residence requirements.
