from PSW to dependent within the UK

hi guys
I was on PSW untill march 2013 then applied for tier 1 entrepreneure ...got refused and appealed
appeal got refused again and my process is going on
if my wife is on student visa in a University course can I apply as her dependent within the UK......I have heard this restriction has been removed recently.....before it was vital to go back home and then apply

please help
