Hi -

I am on Tier 2 ICT Long Term (Issued in Jan 2013, arrived in UK in Mar 2013) in IT sector and my spouse is on Dependent visa. I understand that T2 ICT to ILR route is closed since Apr 2010.

I would like to understand the current possible routes to ILR changing from our current status.

I understand that T2ICT to T2G is not possible without 12 month cool-off.

1. Student/MBA etc. - either me or my spouse studies and the other works.
a. Is this possible? Any specific eligibility?
b. Can the switch be done from within UK?

2. Entrepreneur Visas - With investment (£50K from funding bodies etc. or £200K self) for me or spouse and the other person as dependent.
a. Is this possible with the investment condition satisfied?
b. Can the switch be done from within UK?

3. Any other routes?

The only other route is via marriage or partnership with a person who is settled in the UK or a European citizen registered and living in the UK. (Forget it) :idea:

With respect to you question on education i.e. Student/MBA etc.

a. Is this possible? Any specific eligibility? - Yes its possible, check the university websites for eligibility criteria
b. Can the switch be done from within UK? - Yes can switch within the UK, (i am not sure of dependent but main applicant can switch. I got this information from a solicitor)

Not really sure of Entrepreneur visas

The time you stay in the UK on T2ICT (issued after Apr 2011) will not be counted towards ILR (5 years) but if you manage to stay in the UK (legally) for a continuous period of 10 years (by switching visa categories as and when you have to) then you may be eligible for settlement through the 10 year long residence route. (i would migrate to Canada instead) :mrgreen:

Currently ICT is NOT the visa category one should get into if they are willing to settle in the UK (ICT issued post Apr 2011). :|

It somehow looks like UK is coming up with a system where immigrants can enter its labour market only if they are educated from the UK. but cant say, rules keep changing :shock:

HI,
I have got ICT Tier 2 visa in march 2010 but entered in UK in Feb 2011.

If I continue my stay for till feb 2016 then will I be able to apply for Indefinite Leave to Remain?

Although I entered in UK after 6th April 2010 but I had got ICT Tier 2 VISA in March 2010 (before the rule was applied).

I checked UKBA site and found below information but still my query above remains.
(d) The continuous period of 5 years referred to in paragraph (c) must include a period of leave as:

(i) a Tier 2 (Intra-Company Transfer) Migrant granted under the Rules in place before 6 April 2010, or

(ii) a Qualifying Work Permit Holder, provided that the work permit was granted because the applicant was the subject of an Intra-Company Transfer.
