Post by nanny » Sat Jan 11, 2014 4:12 pm

Hello i am a national of Jamaica and i hold a Jamaican passport which is in my maiden name and my residence card is in my maiden name.
but i received my EU Resident card October 2013 i am Married to a Maltese National who holds his EU passport. for our anniversary he has booked us a holiday in Malta the end of February without telling me because it was meant to be a surprise( i Found out any Way) now i am hearing i need a visa to travel from my home in the UK to Malta but when i phone the Maltese Embassy here in the UK they say to me i don't need any more Visa as long as my Resident card states the i am the family member of a EEA/EU citizen and as long as i am traveling with my husband as long as i bring my marriage certificate to prove we are married. I really dont want our Holiday to become stressfull at the port in Malta if they hassle me and my husband because he will take it very personal and he will go absolutely mental at them especially if he thinks that particular person is being bad with me I know him and he will try to((((( call Race in to it and it wont go down well. HELP,HELP especially he heard the embassy here say i dont need a visa but now we dont know what to do.

But a friend of mine check in Malta at the airport apparently they are saying some thing else that i need a visa to visit malta still please can any one shed any light on my situation because now i'm in pannick........Do I NEED A VISA TO TRAVEL TO MAlta still even though i have my EEA RESIDENCE CARD

If travelling to EU national own country then a schengen visa will need but if EU national is working and shows payslips etc. then under surinder singh route they may let you enter freely.

Surinder singh applies when an EU national worker returns to its homeland. Since you have time and visa will be issued to you freely If you wish to apply otherwise you can try your luck as few people in same situation got success. check the following thread regarding members experience:

You will be fine. Sorry for not replying to your earlier message. Have had an extremely hectic weekend.

Maltese citizens are awarded similar right to EEA national under their constitution, and Malta is very much mindful of the Surinder Singh and Eind provisions.

Furthermore Residence Card issued under Article 10 by other states are recognised by the Maltese authorities. Therefore I am of the view that you will be fine.
