Accidental COS cancellation

Post by rmaprath » Sun Jan 12, 2014 2:06 pm

Hi All,

I'm posting this on behalf of a friend of mine. Any help is highly appreciated.

He is a Tier 2 general visa holder and few weeks ago he tried to resign from his current job by handing over the obligatory one month notice. Then after a discussion with the company directors, he changed his mind and revoked his resignation. However, in the meantime the person who handles the SMS (sponsor management system) for the company has taken the necessary measurements to remove the COS assigned to my friend. Once the resignation was revoked, this person tried to reverse what he did, at which point it transpired that he couldn't find a link within the system which can be used to reinstate the COS or undo a removal of COS from the SMS.

An attempt has been made at this point to contact UKBA and haven't heard anything back from them yet. Wonder whether there are anyone else who has gone through a similar scenario previously?

Unfortunately my friend had to leave UK for an emergency and now he is worried if he'll get in trouble at the boarder since his COS might not be valid any longer. He has taken some documents from the company acknowledging this accident (so that he can produce them tot he boarder) but he is worried if that is not enough.

Can someone please shed some light?

Thank you very much.

Not sure what your friend's sponsor did but they needn't have done anything until your friend's employment finished at the end of the notice period. Whatever they did wasn't necessary and they should phone the HO employer helpline 0300 123 4699 for assistance.

This is exactly what my friend complained to his company about, it's a careless action!

I will pass the information to my friend.

Thank you very much!
