I came to the UK in 2004 on a visiting visa and overstayed. In 2010 I made an application to the Home Office on the basis of the European Convention of Human Right (Article Eight) as the spouse of a British citizen and father of a British citizen child. The application was refused. I immediately asked for reconsideration as I considered the refusal to be a breach of my British spouse's right to private and family life.
In May 2013 (3 years later), I was granted 30 months leave under the immigration rule under the 10 year route to settlement. I would now like to switch to the 5-year route to settlement. I am currently working for an Agency and should be earning between 1,700 to 2,000 per month before tax and would be using my earnings to meet the financial requirement. My intention is to apply to switch to the 5 year route in May/June 2014.
My family and I would like to travel abroad for Christmas in 2014 and I do not want a situation whereby I submit my application to the Home Office in May/June 2014 and the application is not processed in time for our Christmas 2014 holiday. My question now is:
Is it possible to use the premium service to make my application to switch so that a decision can be made the same day
Do my British spouse have to attend the appointment with me?
